To All Kimball House Square Condominium Residents & Owners

 

 

Announcing Updated Regulations and Fines for By-Law and Master Deed Restrictions Violations

 

Effective March 12, 2012

 

 

 

 

Your buildings and Association is now being managed by a professional management company.  With this new management, we look forward to continued improvements in your environment.  In order to keep Kimball House Square Condominiums an upscale living community and one of the most desired places to live in Lexington, The Board of Kimball House Square Condominium Council of Co- Owners   has adopted a system of Rules, Regulations & Related Fines for certain violations that will take effect on March 1, 2012.  The goal of these fines is to gain compliance from residents and owners, not to generate revenue.

 

All of the violations noted below relate to specific rules or regulations contained in the by-laws or to serious safety and hygiene issues that must be addressed.  Of special concern have been a wide range of pet violations.

 

   All owners/landlords are responsible for ensuring that their tenants understand these rules and comply: 

 

First offense warnings, where applicable, and notice of fines will be directed to both owner and resident whenever possible, with the unit owner ultimately responsible for compliance and payment.

 

Compliance and enforcement will only improve the conditions in and around Kimball House Square, which we all want.  Any questions or comments should be directed to the Kimball House Square Council of Co-Owners Board of Directors.

Pet Rules and Regulations:

  • All pets must be registered with the Management Company. 
  • Dogs must be kept on a leash and under the owner’s supervision at all times.  Dogs cannot run at-large or under voice command on the property.  
  • Pets must wear a current license and rabies tag at all times.
  • Any pet whining, barking, parasite infestation, or relieving themselves in areas of the condo building is grounds for fines, expulsion, and/or payment of property damages.
  • Any person having custody or control of any animal and failing to immediately remove and clean up any feces or urine left by any pet inside or outside the building and dispose of in a sanitary manner into the dumpster, (not in trash receptacles by entry doors or in bags in the parking lot) will result in fines.  

Fines for above pet violations:

  • First offense – $50 fine 
  • Second offense – $100 fine
  • Third offense – $150 fine per occurrence plus possible expulsion of pet pending Board review.

 General Rules and Regulations:

  • There shall be no disruptive or excessive noise in common areas including the parking lot or from inside a residence that is disturbing to other residents.  This is a violation of our master deed and local ordinances.
  • No improper disposal of trash (i.e. leaving trash on balconies or in hallways, interior and exterior).
  • Entry doors are not to be propped open for more than temporary moving assistance.
  • There shall be no posting of any type of unapproved signage or posters, or storage of any items in any common area, including but not limited to doors, stairwells, walls, windows,   or exterior balconies.
  • Lost  or broken key fobs may be replaced at a cost of $25.00 by contacting management 
  • Smoking is prohibited in all common areas including common porches, cigarette butts are to be disposed of properly

 

Fines for above violations:

  • First offense – warning only
  • Second offense – $50 fine
  • Third offense – $100 fine 
  • Subsequent offenses – $150 per occurrence plus possible legal action

 

Any unregistered vehicle on the property is immediately subject to tow and or immobilization. Separate parking regulations are attached.
